Ordinance 215.410 - Burning Leaves, Trash, Debris on Paved Streets Within City

 

A. Definitions. For the purposes of this Section, the following terms shall have the meanings indicated below:

Approved Incinerator: An incinerator which complies with all current regulations of the Missouri Air Conservation Commision.

Dwelling Unit: Any room or group of rooms located within a structur, and forming a single habitable unit with facilities which are used or are intended to be used for living, sleeping, cooking and eating.

Refuse: Solid Waste

Solid Waste: Unwanted or discarded waste materials in a solid or semi-solid state, includingbut not limited to garbage, ashes, street refuse, rubbish dead animals, animal and agricultural wastes, yard wastes, dicarded appliances, special wastes, industrial wastes, and demolition and construction wastes.

Yard Wastes: Gras clippings, leaves tree trimmings.

B. It is unlawful for any person to burn solid waste unless an approved incinerator is provided or unlessa variance has been obtained from the appropriate air pollution control agency, with the following exceptions

Burning of Household Refuse (Solid Waste)

Banned Completely

Burning Leaves, Brush, and Vegetation

During the months of October, November and December, any person or persons may burn leaves originating on the premises outside of a screened, noncombustible receptable, but only under such proper safeguards as are necessary in regard to time and weather conditions. During any other months of the year such burning may take place only by obtaining a written permit for such burning from the Kennett Fire Department. In no event may any burning be done on any paved street, sidewalk or alley within the City of Kennett, Missouri.

Burning of Tree Trunks, Limbs & Vegetation from land clearing operations

Only when such burning takes place at a distance equal to or greater than two hunred (200) yards from the nearest dwelling.

Burning trade waste, burning tires, salvage operations by open burning

Banned Entirely by the Missouri Department of Natural Resources (MoDNR)

Agricultural Burning (pest control, crop management)

Fires set in connection with agricultural or forestry related to the growing or harvesting of crops.

Fire Training (firefighters or industrial employees)

Fires set for the purpose pf instructing and training fiemen in the methods of fighting fires.

Recreational fires

Campfires and other fires used soley for recreational purposes, for cermonial occasions, or for outdoor non-comerical preparation of food.

Additional Burning Requirments
(Legal burns)

At all times burning is permitted under this ordinance, a person over the age of eighteen (18) shall be present at the place where the burning is taking place.

C. Nothing in this section may be construed to permit open burning which causes or constitutes a hazard to vehicular or air traffic nor which violates other regulations.

D. Not withstanding any other provisions herein, the Chief of the Kennett Fire Department upon order of the Mayor of the City, may issue a temporary ban upon the burning of all refuse during times when such burning would be a hazard to the health, safety and welfare of the community. Such periods of temporary ban shall be disseminated to the news media and all persons shall be held responsible for such knowledge before burning any refuse.

E. Penalty: Any person or persons violating the terms and conditions of this Section may be ordered to pay all costs of any damage occasioned by such burning, including the cost of any fire call, and assess a fine not to exceed one thousand dollars ($1000.00). (Ord. No. 2446 ss--I VI, 10-3-95)
